One advantage of robot-performed surgery with high-energy radiation is that they can remove tumors contained in a given area or close to critical body parts like the spinal cord with high precision and reduce the side effects (like fatigue) for the patients. In Texas, a heart bypass surgery was accomplished under two hours thanks to Da Vinci. According to Dr. Lewis Wilson, a cardiothoracic surgeon at CRMC, the bypass patients of the Texas surgeon are “back at work in two weeks.”

Blink or Slight of Hand - Hospitals Beware!

A recent National Incident Management System (NIMS) update alert from the NIMS Implementation Center, included obscure reference to a frequently asked question (FAQ) document on the FEMA website. This document, posted on April 20, 2007, like many documents before it was deeply buried within the FEMA website, accessible only to those who knew where to find it.

The last two questions on this FAQ document dealt with a raging debate regarding the repercussions of failing to be NIMS compliant before the looming September 30, 2007 deadline.

The first answered the question of whether the Joint Commission required NIMS compliance for accreditation. The answers stated “Not at this time.”

The second question similarly was a response to inquiries regarding whether CMS required NIMS compliance for Medicare and Medicaid benefits and reimbursements. Again the answer was “Not at this time.”

The April 20th update was posted almost exactly three weeks to the day after High Alert, LLC. privately circulated a pre-released draft of its white paper on the association of NIMS, NRP, the NIMS Implementation Plan for Hospitals and Healthcare, the Federal False Claims Act (Qui Tam) and the Sarbanes-Oxley Act. In that much circulated document, High Alert referenced several early positions by the Justice Department and the NIMS Implementation Center that placed hospitals and other healthcare facilities at risk of Medicare fraud and the repercussions of that fraud under both Federal False Claims Act and Sarbanes-Oxley.

High Alert sounded the claxton alarm warning that failure to be NIMS compliant while still billing Medicare and Medicaid could constitute a violation of the Federal False Claim Act, thus opening institutions to significant legal repercussions.

Several legal scholars had reviewed this potential and concurred with High Alert’s conclusions, adding that willful blindness regarding NIMS Compliance does not constitute a defense. Similarly, the fact that Federal False Claims complaints are sealed for the first 120 days would by necessity mean that healthcare facilities and hospitals filing Sarbanes-Oxley Reports while under a Federal False Claims complaint would be guilty of a second violation, that being a false Sarbanes-Oxley Attestation.

Several officials within the Department of Homeland Security, FEMA and Department of Health and Human Services requested copies of the High Alert draft document in the weeks prior to its official release in early April. Within a week of the release of High Alert’s white paper the FAQ statements were posted to the internet. Interestingly, it was not until late June that the existence of these clarifications was publicized.

This raises the specter of a continuing plan to place hospitals and healthcare facilities in danger of violating of both the Joint Commission Accreditation guidelines and the Federal False Claims Act for failing to be filling NIMS compliance by the September 30 deadline.

Hospitals and healthcare facilities can take a little solace in the fact that this FAQ document state “not at this time” in response inquires that the possibilities raised by High Alert’s document will result in actual federal prosecution.

There further persists the question of whether or not a private relator can bring Qui Tam action under the Federal False Claims Act, despite the fact that the federal government is currently disallowing any intention of bringing such claims on its own, “at this time.”

The history of the Federal False Claims Act demonstrates that enforcement has been primarily at the hand of private citizens acting in the function of “relator” bringing Qui Tam actions thus ever expanding the application and implication of the Federal False Claims Act.

The legal connections between liabilities under Federal False Claims and the Sarbanes-Oxley Attestation has been well-established both by High Alert and by others. Thus when Qui Tam actions are successfully argued for failure to comply with NIMS hospitals and their corporate executives would face serious legal jeopardy.

Of even greater concern is the fact that even if a Qui Tam action were unsuccessful, the fact that the Qui Tam action may not be disclosed by any party requires that the existence of this potential liability be omitted from any Sarbanes-Oxley report filed during the corresponding time frame. This willful omission of a potential liability is the very definition of a Sarbanes-Oxley disclosure violation. Due to this legal “catch 22,” the CEO and CFO who signed the fraudulent Sarbanes-Oxley Attestation face civil and criminal prosecution.

The recent NIMS Integration Center alert and its associated FAQ document may allay the fears of hospitals as they move forward quickly to meet the September 30 implementation deadline. However, those facilities who view this document as reassurance that there are no significant repercussions for failure to be NIMS compliant may find that the copies of the High Alert document circulated at the Department of Homeland Security, FEMA, the NIMS Implementation Center and CMS served as a template for NIMS enforcement.

The ultimate question is, did the Federal government blink or is this a bit of informational sleight of hand?

Defining Pronation

Pronation refers to the natural rolling of the foot from heel to the ball of the foot. And this rolling nature must exist and happen so that the foot can function i.e. walk, run. This is pronation. What are over_pronation and under_pronation?

Over_pronation is at the opposite end of the spectrum from under_pronation or supination. In over_pronation, the arch falls and collapses and there is pain in the plantar fascia at the sole of the foot.

One important difference with under_pronation or supination is that in the latter, the pain happens more in the heel area. However a certain level of over_pronation and under_pronation are both natural and normal in the foot. Supination to an excess is associated with pain in the heel area.

What happens in under_pronation or supination? It occurs when the foot rolls outwards at the ankle. Remember that pronation can be described as the natural rolling of the foot from heel to toe and when then the foot rolls outward, supination happens. Any type of movement or change which affects the natural rolling of the foot is important. You could say that the foot is something that ‘rolls’ naturally and this natural rolling must be carefully ‘controlled’ and understood. The natural rolling of the foot is something to take into account also in shoe design. Indeed, it is a question to ask how this rolling happens.

It is interesting to note also where the pain happens if over_pronation happens to an excess level and under_pronation. With over_pronation, there is pain in the arch of the foot as well as the plantar fascia or sole area. There is also pain in the heel area. However, under_pronation or supination is more associated with the heel area.

We try to understand then the nature of the rolling in the foot. Some people posit a term called neutral pronation which is akin to an even rolling across or through the foot from the heel/ankle area to the ball of the foot/toes. The aim of course is for the foot to adapt to its normal functions such as walking, running.

Note then the nature of the foot. You can think of it as a kind of rolling plain and it may not be a 2dimensional plain but perhaps a 3d plain. This is because of the ‘rolling’ as well as the central structure of the arch which of course influences the structure and shape of the foot. The heel and the ball of the foot lie then at two ends of the foot and you can say that the sole is not just a level plain. As said, there is the arch at the centre …and remember that when the arch falls there is a that flat and fallen plain or ‘fallen feet’. And this causes acute pain in the plantar fascia. It is not normal to have such a straight flat plain and in footwear design, account must be made of this point.

Now remember again the ‘rolling motion’ of the foot. Some describe this as ‘pronation’. Supination, as said, is outwardly directed and over_pronation on the other hand occurs when there foot rolls ‘inside’. It is difficult to imagine to what you can compare this whole ‘rolling’ structure, as to picture better the nature of rolling. ‘rolling’. Yes the foot seems to roll ‘inside’ and ‘outside’ and at the core of this rolling is the arch which gives the shape to the foot. When it falls, it directly affects the rolling.

Some notes on the nature of the arch of the foot as well as pronation, a central concept in footwear:

You could say that the arch gives height to the foot. However is height the right property associated with the arch of the foot? Indeed the foot is something so three-dimensional so you must ask if height is the correct property. Still height seems to be the closest property that one can give to the arch. The arch indeed is what gives height to the foot. And note that a high arch is associated with supination.

The foot then rolls to the inside and this is over_pronation and this inward rolling affects the actual arch structure and bringing about the flattening of the arch.

Yes indeed supination and over_pronation at normal levels are important for the foot. It is part of the foot’s adaptation to its functions of walking and running. The problems happen when there is excess inward or outward ‘rolling’.

How important is it for athletes to understand the nature of pronation. The arch is a central structure in the foot and it is at the core of an understanding of pronation. It seems that running shoes generally come in straight, curved and semi curved shapes.

It makes sense for those people susceptible to over_pronation or fallen feet to wear straight shoes. A straight shaped shoes reduces the chances of a fallen arch and it keeps the arch structure in place. A curved shape shoe is suitable for people more susceptible to supination. A curved shape counters any outward rolling of the ankle that might occur. If a straight sole is important in over_pronation, then a bolstered cushioned shoe structure is suitable in supination.

In over_pronation, the arch flattens; the foot is flattened. The arch, which has given shape and structure to the foot, has fallen and there is a flat foot, which means pain in the sole. Think about something falling inside you, inside a body such as the foot. This is the arch and note that this arch is like a central structure which falls down and drops and affects all around it and in over_pronation, the whole central structure of the foot, which was the arch has fallen.

      Undigested food is the common reason of gas in the abdominal. This undigested food then passes from the small bowel into the large bowel, where normal, harmless bacteria break down the food, producing hydrogen, carbon dioxide, and, in about one-third of all people, methane. Eventually these gases exit through the rectum. But it is not a common disease because if a person suffered gas with undigested food it is not compulsory that another will also suffer with it.
